{"id":166,"date":"2025-06-06T06:57:40","date_gmt":"2025-06-06T05:57:40","guid":{"rendered":"https:\/\/blogs.cardiff.ac.uk\/housing-law-wales\/?p=166"},"modified":"2025-06-03T15:50:34","modified_gmt":"2025-06-03T14:50:34","slug":"shared-ownership-new-code-launched","status":"publish","type":"post","link":"https:\/\/blogs.cardiff.ac.uk\/housing-law-wales\/shared-ownership-new-code-launched\/","title":{"rendered":"Shared ownership &#8211; new code launched"},"content":{"rendered":"<p>I&#8217;m afraid that I am, and have been for the last 30 years (since I came across it), a shared ownership sceptic.\u00a0 With my colleagues, I have written fairly extensively about it in England, although have moved on since around 2019.\u00a0 You can find our policy report, following research funded by the Leverhulme Trust, <a href=\"https:\/\/www.york.ac.uk\/media\/chp\/documents\/2015\/sharedOwnershipCHPL.pdf\">here<\/a>.\u00a0 I know that there have been some improvements sought to be made to the &#8220;product&#8221; since then, but everything I read about it suggests that the issues remain the same (see, for example, <a href=\"https:\/\/www.theguardian.com\/money\/2024\/sep\/22\/affordable-shared-ownership-homes-cost-residents-more-than-half-their-wages\">here<\/a> and <a href=\"https:\/\/www.theguardian.com\/society\/2025\/mar\/09\/uk-housing-associations-accused-of-mis-selling-affordable-homes-as-service-charges-soar-by-up-to-400\">here<\/a> and <a href=\"https:\/\/www.theguardian.com\/money\/2025\/mar\/01\/theres-no-way-i-can-pay-london-residents-despair-of-steep-costs-and-forced-use-of-poor-door\">here<\/a>).\u00a0 Shared ownership is a &#8220;product&#8221;* (see end) which is also backed by the <a href=\"https:\/\/www.gov.wales\/shared-ownership-wales\">Welsh Government <\/a>and so the announcement of a <a href=\"https:\/\/www.sharedownershipcouncil.org.uk\/s\/Shared-Ownership-Code-2025.pdf\">Shared Ownership Code<\/a>, following consultation and pilot projects, is important to its ongoing development.\u00a0 However, the Code does not mention Wales or Welsh approaches to shared ownership, only English regulations and .\u00a0 Was that an oversight?\u00a0 Are they intending to do work separately in Wales?<\/p>\n<p>The Code is the brainchild of the <a href=\"https:\/\/www.sharedownershipcouncil.org.uk\/\">Shared Ownership Council<\/a>, which itself is a product of an industry recognition of weaknesses in the marketing and operation of shared ownership (I&#8217;d say &#8220;front-to-back&#8221;).\u00a0 It comes from work done by Lloyds Bank, I think.\u00a0 There are no Welsh members of the Council&#8217;s board as far as I can see.<\/p>\n<p>It is important to note that the Code is voluntary, and organisations will have to sign up to it &#8211; one can imagine that it will be <em>de rigueur<\/em> to sign up to it as it develops and the industry itself seeks to rehabilitate the &#8220;product&#8221;.\u00a0 One of the central issues lies with how shared ownership is sold, and the Code requires its signatories to provide as much up front information as they should in as transparent a way as they should be doing; charging fees that are reasonable; a defects period for new builds of 12 months; dealing properly and appropriately and sensitively with financial hardship (although it does not require signatories to allow for downward staircasing).\u00a0 In particular, on the hardship issue:<\/p>\n<blockquote><p>Providers must not seek possession where a reasonable alternative exists.
